2015/06/24 Urgenda wins climate case
against Dutch state. On 2018/10/09 again!
You enter with a pit in you stomach
and then very slowly...
point for point you think this can't be true.
And yes, it happens again.
The Dutch cabinet has received today
a hefty slap on the wrist by a judge.
The climate policy of the cabinet
is no good.
The court forces the government to do more
against the emissions of CO2.
Climate organisation Urgenda has also been proved right
by a judge in the appeal of the climate case.
All previously mentioned arguments lead to
the conclusion that the state has acted unlawfully...
in breach of the duty of care of Articles 2 and 8
of the European Convention on Human Rights...
...by neglecting further emission reductions
by end 2020.
The state has to reduce emissions
with at least 25% by the end of 2020.
This was an incredible beating for the state
and it couldn't have gone better.
We were proved right on all points.
I'm very happy, I'm very proud.
I'm very happy that they were proved right in all respects,
both legally and with respect to the content.
For as far as the state wanted to argue, that the time
remaining to the end of the year 2020 is very short...
...this argument is rejected.
Not only does the previous verdict
date to more than three years ago...
...but in addition, the state was beforehand
already aware of the severity of the climate problem.
It should be noted that until the year 2011 the state
actually pursued a target of thirty percent reduction.
The state argues, for instance,
that it's a global problem...
that the Netherlands depends
on what other countries are doing.
Aobut that, the chairwoman says it does
not exempt the Netherlands of its own duty of care.
Also the argument that the state already has big plans
for 2030, in twelve years time, is rejected.
The fact of the matter is that the situation is so urgent
that immediate measures are required...
...for the short term!
